On September 29, 2023, a United States District Court judge granted class certification in a class action lawsuit against a major pet food manufacturer over its prescription pet food. This means that the lawsuit can proceed on behalf of all pet owners who purchased the food in Illinois between 2018 and 2019.

The lawsuit alleges that the manufacturer falsely advertised its prescription diet as being necessary for certain health conditions. The plaintiffs claim that the prescription diet is not materially different from regular cat and dog food, and no prescription is necessary to buy it.

The manufacturer has denied the allegations in the lawsuit, but the judge’s decision to grant class certification is a significant victory for the plaintiffs. The lawsuit is now in the discovery phase, and the parties are expected to begin exchanging evidence in the coming months.  This is just another reason why you should ask about what’s in your pet’s food.
